                _Terms & Conditions

                The following terms and conditions are set out to insure that the entertainment that we provide meets certain expectations, and guarantees the evening moves smoothly and professionally for both the 'artist' and 'client'.

                Justplay Management terms of business

                1: Definitions

                Booking contracts are negotiated by Justplay Management (the 'agent') between the 'client' and the 'artist'. In this respect, Justplay Management acts as an employment agency whose sole purpose is to organise and provide both parties with appropriate written agreements.

                2: Confirming the booking

                I) 'Confirmation' will mean electronic or written acceptance of this booking by both the 'client' and the 'artist'.

                II) All bookings take effect immediately upon 'confirmation'.

                III) If the 'confirmation' is not returned and signed with the appropriate deposit, 7 working days from dispatch JUSYPLAY MANAGEMENT will be unable to hold the pre-arranged date for the event.

                3: Payment of fees

                The agreed booking deposit is due within 7 working days from the receipt of the confirmation, and should be paid by cheque BACS made payable to Countdown to California or CTC.

                Unless otherwise agreed by the 'artist' and Justplay Management in writing on the cover of your contract, the balance is payable to the 'artist' in cash or by cheque on the day of the event.

                4: Cancellations

                Cancellation by the 'client':

                Cancellation by the 'client' is not allowed for any reason except circumstances covered by 'force majeure' (see cause 9). In the event that the 'client' cancels the booking, the 'client' agrees to inform Justplay Management immediately. Justplay Management agrees to inform the 'artist' of the cancellation immediately.

                I) Cancellation by the 'client' within 48 hours of confirmation will not carry a cancellation fee unless the event date is within the following seven days in which case the booking fee will be due.

                II) Cancellation by the 'client' after 48 hours of confirmation and up to 90 days from the event will result in loss of deposit.

                III) Cancellation by the 'client' within 60 days of the event will result in loss of deposit and 50% of the remaining balance will be payable by the 'client' to the 'artist' within 14 days

                Artist cancellation fees should be sent to Justplay management to be forwarded onto the 'artist' within seven days of receipt.

                Cancellation by the 'artist':

                The Artist may only cancel a booking if affected by Force Majeure (see clause 9) or up to 31 days prior to performance. In the unlikely event that the 'artist' cancels the booking. The 'artist' agrees to inform Justplay management immediately. Justplay management agrees to inform the 'client' of the cancellation and make all reasonable attempts to find a suitable replacement artist of similar standard and style, at no extra cost to the 'client'.

                Should a suitable replacement not be found, Justplay Management agrees to refund the 'client' their deposit plus any other booking fees already paid in advance.

                There will be no refund given to the 'client' against the booking deposit already paid, and no administration charge will be made to the band if a replacement artist of similar value can be arranged by Justplay management and agreed by the 'client'.
                However, should a replacement artist charge a much lower fee, the 'client' will be refunded a proportionate amount of their booking deposit and the replacement artist will be due their usual fee. Where possible, the 'client' and 'artist' will be contacted to agree this in advance.


                The 'artist' withholds the right to cancel up to 31 days before the performance. In this unlikely event the client is entitled to a full refund including deposit. It is the responsibility of JustPlay music management to find a suitable replacement within the best of their ability.

                5: Changes on the day

                Where possible, changes to the contract schedule which are unavoidable on the day of the event should first be discussed and agreed with Justplay Management. Should this not be possible, changes are to be agreed between the 'client' and the 'artist' prior to the performance.

                6: Standard 'artist' requirements

                6.1 Power

                It is the responsibility of the 'client' to ensure that a safe source of power is provided for the 'artist' and that all local authority regulations are adhered to.
                All bands and acts will require a minimum of 32 amps of power, with the relevant power points and sockets pre-arranged between the 'artist' and 'client'.

                6.2 Venue constraints

                It is the responsibility of the 'client' to ensure that the performance venue will provide a safe performance are, and to ensure that the venue is happy to accommodate the performance of such live music, including any live music licenses.

                Other considerations such as noise limitations and curfews should be mutually agreed between Justplay Management and the 'client' prior to booking.
                Any relevant information should be disclosed to Justplay Management prior to booking confirmation.


                6.3 Performance area

                It is the responsibility of the 'client' to ensure that a suitable performance area is provided. This should ideally be a raised stage to distinguish the staging are from the dance floor.
                However, the 'artist' can perform without raised staging if necessary.

                The minimum size requirements for performance space are as follows:

                Width = 5m
                Depth = 3m

                6.4 Safety

                The 'artist' reserves the right to cancel the performance if they deem it unsafe to perform. In the unlikely event of this happening, the 'client' will still be liable for the full payment of the agreed booking.

                6.5 Refreshments

                It is the responsibility of the 'client' to provide suitable refreshments for the band on the day of the event. Any food arrangements will be pre-arranged between the 'client' and the 'artist'.

                6.6 Parking

                It's is the responsibility of the 'client' to organise practical parking for the day of the event. This must be able to accommodate a 3.5 tonne, high roofed van and be situated as close to the performance area as possible. 

                6.7 Vehicle charges

                In light of the new London emissions regulations a £100 surcharge will be applicable for any events within the M25.
                This is also applicable to any congestion charges, toll roads and/or parking charges.

                7: Artist service guarantee

                The 'artist' agrees to provide a performance that is to the best of their ability, and reflects full the likeness of the 'artist's show, as known to Justplay Management and as advertised to the 'client' via distribution of the 'artist's demo CD's, promotional materials, profiles, pictures, videos, web page etc. The 'artist' will make every effort to make sure their performance is outstanding, adhere to the 'client's wishes within reason, be polite and courteous with the 'client', their guests and all venue staff and contractors.

                The 'artist' agrees to provide all equipment required to undertake this performance, unless the equipment has been contractually agreed to be provided by the 'client' or a third party. It is the 'artist's responsibility to ensure the good working order and safety of their own equipment, and to obtain all necessary insurance documentation and certification.

                The 'artist' shall be suitably dressed during their performance except with the consent of the 'client' of where the wearing of other attire is deemed to be a necessary part of their act.

                8: Artist equipment

                It is agreed by the 'client' and the 'artist' that the equipment and instruments of the 'artist' are NOT available for use by other performers or persons except by specific permission from the 'artist'.


                If the 'artist's equipment is damaged by the 'client' or 'clients' guests, the 'client' is fully liable for any costs incurred.

                If the venues electrical system shorts out and damages equipment the 'client' will be liable for any costs incurred in replacing said equipment.

                9: Force majeure

                In cases of 'force majeure' (which shall be known as war, fire, death, illness or other capacity certified by a properly qualified medical practitioner, epidemic, accident, civil commotion, national calamity, order of government or local authority having jurisdiction in the matter, changes in law, foreign government policy, act of god), which are not attributable to any act of failure to take preventive action by the 'artist' of 'client', then the 'artist' or 'client' may cancel this booking without penalty other than loss of deposit.

                In the event of extreme weather conditions e.g. heavy snowfall around the date of the event, the 'artist' reserves the right to cancel the performance if deemed too dangerous to travel or if the route to the venue is blocked.
